A court has dismissed a claim by a Torrevieja City Council police officer seeking productivity pay while on sick leave, ruling that such bonuses require active service. The officer argued that denying the payment was discriminatory, as he had worked efficiently for part of the period.

However, the Administrative Court No. 2 of Elche found that productivity bonuses are based on objective criteria, including a minimum positive working hours balance. The claimant worked only 40 of the required 90 days in the first half of 2024 and failed to meet the necessary threshold, ending the period with a negative time balance.

The judge concluded there was no discrimination, as the rules apply equally to all staff and are tied strictly to measurable performance. The appeal was rejected, and the officer was ordered to pay legal costs. The ruling reinforces that productivity supplements cannot be granted without fulfilling established work and performance conditions.
