In a trial starting on Tuesday in the Elche section of the Provincial Court, evidence will be heard against a man accused of having a sexual encounter with a woman who was asleep and who struggled with him when she woke up.
The Prosecutor’s Office is asking for six years in prison for the man involved in the incident which took place on July 4, 2018 when they were both at a vacation home in Torrevieja and, according to the account given by the Prosecutor’s Office in its indictment, the man made two attempts to have sex without her consent.
First, he took advantage of the fact that the victim was sleeping to try to have sexual relations, the woman woke up and reproached him for his attitude. However, when she fell asleep again, the defendant, with the intention of violating her sexual freedom again, forced her sexually.
