The High Court of Justice of the Valencian Community (TSJCV) has ordered the Generalitat Valenciana to pay 112,505 euros in compensation to a student injured during a Physical Education lesson at IES Torrevigía de Torrevieja.
The Administrative Litigation Chamber of the TSJCV in Valencia confirmed this amount, raising it from an initially approved 44,000 euros. Additionally, the Ministry of Education must cover the interest accrued since the first complaint was resolved in 2019.
The incident occurred on May 10, 2017, when the student tripped over a nylon rope while warming up, resulting in head and cervical trauma, two skull haemorrhages, and jaw damage. After losing consciousness and convulsing, he was transferred to Torrevieja University Hospital and later to the ICU at the General Hospital of Alicante. Seven years later, the student continues to suffer from epilepsy and mild cognitive disorders.
While the Generalitat acknowledged the accident’s facts, it contested the compensation amount. In February 2021, the head of the Patrimonial Management Service of the Ministry of Education admitted the student’s right to compensation but reduced it to 44,000 euros. The student’s family appealed for 269,095 euros, ultimately securing 112,505 euros.
