Just a few weeks ago, Cambiemos Orihuela denounced the refusal of Vectoris the new contracting company for the Municipal Sports Centres, to pay the outstanding salaries that are still owed to the staff. Indeed, neither has Vectoris paid the salaries for the month of November.

This attitude clearly breaches the provisions of article 44 of the Workers’ Statute, which states:

‘The change of ownership of a company, a work centre or an autonomous production unit shall not in itself extinguish the employment relationship, the new employer being subrogated to the employment and social security rights and obligations of the previous employer, including pension commitments, under the terms provided for in its specific regulations, and, in general, any obligations in terms of complementary social protection acquired by the transferor.’

As the successful bidder of the contract, the new company Vectoris is obliged to assume these labour rights and obligations. And, ultimately, the municipality, as the main contractor of the service, has a joint and several liability that cannot be ignored.

It is even more inconceivable that, after taking over this emergency contract, Vectoris is justifying the delay in the payment of the first month’s wages with excuses such as lack of initial organisation. This demonstrates an unacceptable lack of planning and commitment, which only aggravates the situation of the workers, who have already endured far too much uncertainty.

Cambiemos Orihuela is demanding that both the company awarded the contract and the Ayuntamiento comply with their legal responsibilities and guarantee the rights of the workers. Thy say that they we will not allow them to continue to be the victims of incompetence and lack of commitment on both sides.
